Approval of food business establishments

You may need approval if you produce dairy products, meat products, fishery products, egg products, minced meat or meat preparations.

Licence summary

Generally if you are manufacturing products containing ingredients of animal origin, and you are processing any of the ingredients, you will need approval. Processing would include heat treatment eg pasteurisation of a dairy product. The basic principle is that food safety hazards are controlled at the point of production.

Eligibility criteria

Your food business may require approval if you intend to use "unprocessed products of animal origin" e.g. raw meat, raw minced meat, raw milk or eggs to produce any, or a combination of the following:

  • Minced meat
  • Meat preparations
  • Mechanically separated meat
  • Meat products
  • Live Bi Valve Molluscs
  • Fishery products
  • Raw milk (other than raw cows' milk)
  • Dairy products
  • Eggs (not primary production)
  • Egg products
  • Frogs legs and snails
  • Rendered animal fats and greaves
  • Treated stomachs, bladders and intestines
  • Gelatine and collagen

The requirement for approval will include certain cold stores and certain wholesale markets.

If your food business requires approval there are a number of requirements which need to be followed and if your business is based in the Peterborough area you cannot operate until your food operation has been approved by this authority. There are however, a number of exemptions.

The approval process requires that you put in place procedures to manage food safety and that these procedures be based upon hazard analysis and critical control points (HACCP) principles.

Application evaluation process

If your business is based in the Peterborough area you cannot operate until your food operation has been approved by this authority. If you are unsure as to whether your business needs approval please contact Peterborough City Council.

You can apply by completing the Application for Approval of a Food Business Establishment (see the apply online link below). With the completed form you will need to attach all the relevant documents as listed on the application form.

We will contact you to arrange for a visit to your premises. We will visit your premises within 28 days of receiving your application. The visit will encompass a full inspection of the establishment to verify that all systems, procedures and documentation meet the relevant requirements of Regulation 852/2004 and Regulation 853/2004. After the visit there may need to be a planned programme of works in order to achieve approval and you and/or your employees may need to have further training proportionate to the size and nature of your business.

Once we have assessed your premises your establishment may be granted full approval, granted conditional approval or approval may be refused.

Once your business is approved we will issue your establishment with a unique approval number which makes up part of the standard identification mark which must be applied to your products and documentation.

To ensure that you are complying with the labelling requirements you will need to contact Trading Standards at Peterborough City Council.

Will tacit consent apply?

No. It is in the public interest that the authority must process your application before it can be granted. If you have not heard from Peterborough City Council within a reasonable period (28 calendar days) please contact us.

Fees

There is currently no charge.

Failed application redress

If an establishment does not fully meet the legal requirements, Peterborough City Council may grant conditional approval or may refuse approval.

If we decide to refuse an application for approval, we will notify you in writing as soon as possible. We will give the reasons for refusal, the matters necessary to satisfy the requirements and make it clear that activities requiring approval may not be undertaken unless approval or conditional approval is granted.

If your application for approval is refused, you can appeal to the local Magistrates’ Court.

Consumer complaint

We would always advise that in the event of a complaint the first contact is made with the trader by you - preferably in the form a letter (with proof of delivery).
