Nuisances

A nuisance is where the actions of another are unreasonable and cause a substantial interference to the use and enjoyment of a resident’s property or are prejudicial to health.

Nuisances that can be investigated by the council are outlined in the Environmental Protection Act 1990 and are:

  • Noise
  • Houses prejudicial to health
  • Smoke
  • Fumes or gases
  • Dust, steam, smell or effluvia from a trade or business premise
  • Accumulations
  • Animals
  • Light
  • Flies

To investigate a statutory nuisance the council needs to know the location, times, duration and  frequency of the nuisance. It also needs to establish the likelihood of  it happening again.  The actions must be unreasonable therefore complaints such  cooking odours from homes may not be investigated.  Residents can also use the same legislation to take their own action, section 82 is designed for residents to use. Please be aware that  the council cannot consider anonymous complaints when trying to establish if a statutory nuisance exists. The source of the nuisance must be identified.
