Do I need planning permission?

Flues associated with biomass heating systems and Combined Heat and Power (CHP) systems

As of the 1 December 2011 the installation, alteration or replacement of a flue forming part of a biomass heating system and/or a CHP system on a dwellinghouse or block of flats does not need planning permission as long as:

• The height of the flue would not exceed the highest part of the roof by one metre or more

• It is not located on a wall or roof slope which fronts a highway if situated in a Conservation Area

Definitions

Block of flats means any building which consists wholly of flats
 
Detached dwellinghouse or detached building means a dwellinghouse or building, as the case may be, which does not share a party wall with a neighbouring building
 
Roof - the regulations do not explicitly define “roof” here but at Peterborough City Council we will interpret the highest part of the roof to exclude the chimney unless further clarification is provided to us by Government or case law
