S106 planning agreements
Decisions for all new residential units and commercial
development (above a certain threshold) will be subject to a legal
agreement. An example of this would be a case where the applicant
is required to pay the City Council to improve open space near the
site to meet the needs of development and benefit the wider
community. In these cases a decision notice will not be issued
until the legal agreement has been signed. A draft Heads of Terms
needs to be submitted with the application as part of the
validation process. This can be done online
or via a downloadable form.
