Traffic regulation order consultations

Any of the previously mentioned types of TROs have to go through a statutory consultation process to allow those affected to comment before the TRO can take legal effect. 

Who do we consult?

The requirements are set out in "The Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations, a Statutory instrument approved by Parliament.  The most recent version was made in 1996 although some aspects of older versions are still relevant. Those who must be consulted about proposed Traffic Orders are:

  • the emergency services
  • the Freight Transport Assocation and the Road Haulage Association
  • public transport operators whose services would be affected
  • others organisations representing those who may be affected, an example might be a parish council
  • residents/owners of properties which appear to be directly affected

Consultation with you

A consultation period of 21 days from the date of publishing the formal notice is allowed, so that anyone who wishes to comment on the proposals can do so.  It is a requirement of the Regulations for objections to be made in writing for formal consultations.  Contact details are included on each TRO consultation according to whether it is a formal or informal consultation.  All written comments are taken into consideration.  The final decision about how to proceed is taken by the Head of Environment, Transport and Engineering on behalf of the Council.
